Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ProofAware website, the managed EU Cloud service, and optional premium course packs (together, the "Service").

The Service is operated by Badr Mouslik, Am Bach 2a, 78247 Hilzingen, Germany ("Provider", "we", "us"). Contact: hello@proofaware.com. Full provider details are in our Impressum.

ProofAware is a security awareness training platform offered as managed EU Cloud with Free, Pro, Advanced, and Enterprise plans, plus optional premium course packs. These Terms cover the website and the managed Cloud service. Indicative packaging and prices on the marketing site are not a live checkout offer until billing is ready.

To use the Cloud service you must create an account and a Workspace. You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. You must be authorized to act on behalf of the organization you register.

There is no live checkout today. Paid plans become binding only once final prices, checkout, and contract documents are confirmed. Early paid pilots may be invoiced directly by the Provider.

When self-serve billing is available, paid subscriptions will be sold through our reseller Paddle.com Market Limited ("Paddle") as Merchant of Record. Paddle would then be the seller of record, issue the invoice, and collect applicable VAT or sales tax. That purchase would also be subject to Paddle's buyer terms. Until Paddle seller verification succeeds, ProofAware does not take card payments and does not promise a Paddle checkout.

Subscriptions are billed in advance on a recurring basis and renew automatically at the start of each billing period until cancelled. You may cancel at any time; access continues until the end of the current paid period. We may change prices or plan features with reasonable prior notice; changes take effect at your next renewal.

Cancellation and refund rights are described in our Refund Policy, which forms part of these Terms. Statutory withdrawal rights for consumers, where applicable, are not affected.

You agree not to misuse the Service, including by attempting to gain unauthorized access, disrupting the Service, uploading unlawful content, infringing intellectual property, or using the Service to violate applicable law. We may suspend access for material or repeated breaches.

You retain ownership of the data you submit. ProofAware processes personal data as described in the Privacy Policy. Completion records may carry a cryptographic Completion Signature so they can be independently verified; you are responsible for how you share verification links.

The ProofAware name, logo, the Cloud service, and premium course packs are owned by us or our licensors. Nothing in these Terms transfers ownership of our intellectual property to you.

The Service is provided on a commercially reasonable-efforts basis. To the extent permitted by law, the Service is provided "as is" without implied warranties, and our liability is limited.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for breach of these Terms or where required by law. On termination, your right to use the paid Service ends.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email, and the "last updated" date above will be revised.

These Terms are governed by the laws of Germany. The courts of Konstanz, Germany have exclusive jurisdiction. For consumers in the EU, mandatory consumer-protection provisions of the consumer's country of residence remain unaffected. The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
